Please note that, in 2005, several states made changes to their rules governing life insurers' underwriting practices as they relate to foreign travel. It is expected that in 2006 more states will take up this issue. Washington State passed legislation that became effective July 24, 2005, and California passed legislation that became effective January 1, 2006. Both laws effectively prohibit life insurance companies from taking any adverse action based solely on the proposed insured's past or future lawful travel. These changes seem to mean that an applicant cannot be declined or rated in these states solely because of past or future travel. However, other underwriting considerations - such as medical history, family health history, or additional lifestyle issues - can still affect the underwriting decision. It also must be understood that if actuarial data can still support adverse underwriting for people that travel, companies will do so to the extent that states allow. |
